1. OBJECT AND SCOPE OF APPLICATION.
The present General Conditions of Use (from now on, the Conditions of Use) have as object to regulate the access to the contents and services for not registered users of the Web Page property of Braco Basics SL. with address in C/Periodista Ramón Resa 20, 41012, Seville (Spain) with CIF: B-90349580, (from now on, Manolito Basics), located in the URL www.manolitobasics.com.
The fact of accessing, navigating or using the services and contents of the Web Page implies that the User has read, has knowledge and accepts without reservations the Conditions of Use.
In this sense, the person who makes use of, navigates or accesses any of the contents and services offered on the Web Page shall be considered a User.
The User agrees to use the Web Page in accordance with the Law and the provisions of these Terms of Use and the Privacy Policy published on the Web Page. The User shall refrain from using the Web Page in any way that is illicit or contrary to these Conditions of Use.
Nevertheless the access to certain contents and the use and/or acquisition/provision of some services is subject to certain Particular Conditions or General Conditions of Contracting, that, according to the cases, will replace, complete and/or modify the present Conditions of Use, and in case of contradiction, the contradictory terms of the Particular Conditions or General Conditions of Contracting will prevail over those stipulated in the present Conditions of Use.
Manolito Basics reserves the right to modify the presentation, configuration, content of the Web Page and any of its services, as well as the conditions required for its access, use and/or rendering of services offered. The access and use of the contents and services after the entry into force of its modifications or the changes in the conditions imply the acceptance of the same.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

It is also forbidden to modify, copy, reuse, exploit, reproduce, communicate publicly, make second or subsequent publications, upload files, send by mail, transmit, use, treat or distribute in any way all or part of the contents and products, included in www.manolitobasics.com.es for public or commercial purposes, if you do not have the express written authorization of Manolito Basics.
3. USE OF THE WEB PAGE.
The User will have access to the contents and use of the services provided by the Web Page free of charge, although some services can be subject to previous registration, previous contracting and/or the payment of an amount by the User, which will be specified in its own General Conditions of Contracting.
By using the services and/or accessing the contents of the Web Page, the User declares his/her conformity with these Terms of Use, undertaking not to use them to send messages that defame or insult, or that contain false information, that is inappropriate, abusive, harmful, pornographic, threatening, damaging to the public image or the private life of third parties or that for any reason violate any law.
In particular, and merely indicative and not exhaustive, the User agrees not to capture data for advertising purposes, not to send any type of online advertising and not to transmit, disseminate or make available to third parties through the Services that may be provided by Manolito Basics, information, messages, graphics, sound or image files, photographs, recordings, software and in general any kind of material, data or content that, without exhaustive purpose:
- Incur in illicit, illegal or contrary to good faith and public order activities;
- In any way contravene, undermine or infringe fundamental rights and public freedoms recognized in the Constitution or in international treaties and in the rest of the legal system;
- Induce, incite or promote criminal, denigratory, defamatory or violent actions;
- Induce, incite or promote discriminatory actions, attitudes or ideas based on sex, race, religion, beliefs or age;
- Incorporate criminal, violent or degrading messages;
- Induce or incite to engage in practices that are dangerous, risky or harmful to health and psychological balance;
- Are false, ambiguous, inaccurate, exaggerated or extemporaneous, in such a way that they may induce to error about their object or about the intentions or purposes of the communicator;
- Are protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained from their owners the necessary authorization to carry out the use he/she makes or intends to make;
- Violate the business secrets of third parties;
- Are contrary to the right to honor, to personal and family privacy or to one's own image;
- Infringe the regulations on secrecy of communications;
- Cause, due to their characteristics (such as format, extension, etc.), difficulties in the normal operation of the Services.
4. LICENSE ON COMMUNICATIONS.
In the case that the User sends information of any type to Manolito Basics through the Web Page, by means of the channels arranged to such purpose in the own Page, the User declares, guarantees and accepts that he has the right to do it freely, that this information does not infringe any right of intellectual property, of mark, patent, commercial secret, or any other right of third party, that this information does not have confidential character and that this information is not harmful for third parties.
The User recognizes to assume the responsibility and will leave harmless Manolito Basics for any communication that he supplies personally or in his name, reaching such responsibility without any restriction the accuracy, legality, originality and ownership of the same one.
5. RESPONSIBILITIES AND GUARANTEES.
Manolito Basics cannot guarantee the reliability, utility or veracity of the services or the information provided through the Web Page.
Consequently, Manolito Basics does not guarantee and is not responsible for: (i) the continuity of the contents of the Web Page; (ii) the absence of errors in such contents or products; (iii) the absence of viruses and/or other harmful components in the Web Page or in the server that provides it; (iv) the invulnerability of the Web Page and/or the impregnability of the security measures adopted therein; (v) the lack of utility or performance of the contents and products of the Web Page; (vi) the damages caused, to itself or to a third party, by any person that infringes the conditions, norms and instructions that Manolito Basics establishes in the Web Page or through the violation of the security systems of the same one.
Nevertheless, Manolito Basics declares that it has adopted all the necessary measures, within its possibilities and the state of the technology, to guarantee the operation of the Web Page and to avoid the existence and transmission of virus and other harmful components to the Users.
If the User has knowledge of the existence of any illicit or illegal content, contrary to the laws or that could suppose an infraction of intellectual and/or industrial property rights, he/she should notify it immediately to Manolito Basics so that it can proceed to the adoption of the appropriate measures.

In case that from the Web Page, the User could find links to other Web Pages by means of different buttons, links, banners, etc., these would be managed by third parties. Manolito Basics has neither power nor human or technical means to know, control or approve all the information, contents, products or services provided by other Web sites to which links can be established from the Web Page.
Consequently, Manolito Basics will not be able to assume any type of responsibility for any aspect related to the Web Page to which a link could be established from the same one, specifically, by way of example but not limited to, on its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
In this sense, if the Users had effective knowledge of the illicitness of activities developed through these Web pages of third parties, they should communicate it immediately to Manolito Basics in order to proceed to disable the access link to it.
The establishment of any type of link from the Web Page to another external Web Site will not imply that some type of relation, collaboration or dependency exists between Manolito Basics and the person in charge of the external Web Page.

- Manolito Basics does not authorize the establishment of a link to the Web Page from those Web Sites that contain materials, information or illicit, illegal, degrading, obscene contents, and in general, that contravene the morality, the public order or the generally accepted social norms.

7. DURATION AND MODIFICATION.
Manolito Basics will be able to modify the terms and conditions here stipulated, totally or partially, publishing any change in the same form in which these Conditions of Use appear, through any type of communication directed to the Users.
The temporary validity of these Terms of Use coincides, therefore, with the time of their exposure, until they are totally or partially modified, at which time they will become effective in the modified Terms of Use.
Independently of what can be disposed in Particular Conditions that are established, Manolito Basics will be able to terminate, suspend or interrupt, at any time without need of notice, the access to the contents of the page, without possibility on the part of the User to demand any compensation. After such termination, the prohibitions of use of the contents previously exposed in the present Conditions of Use will remain in force.
8. GENERAL.
The headings of the various clauses are for information purposes only, and shall not affect, qualify or extend the interpretation of the Terms of Use.
In the event that any provision or provisions of these Terms of Use shall be held invalid or unenforceable, in whole or in part, by any court, tribunal or administrative body having jurisdiction, such invalidity or unenforceability shall not affect the other provisions of the Terms of Use.
The non-exercise or execution on the part of Manolito Basics of any right or provision contained in this Legal Warning will not constitute a resignation to the same one, except for recognition and agreement in writing on its part.
9. CONSUMER GOODS WARRANTY
In case of defective product, the seller must proceed to the substitution or resolution of the contract, steps that will be free for the consumer and user. The consumer and user must inform the seller of the lack of conformity within fifteen days of becoming aware of it. Previously, and since Manolito Basics is informed about the defective product, this one will go through a quality control in which it is distinguished if the defect corresponds to the use of the article or to a manufacturing defect.
10. JURISDICTION.
These General Conditions are governed by Spanish law. The parties submit, at their option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user's domicile.
